Section 138 Notice (Cheque Bounce)

As the bouncing of checks is a recognizable offense under Section 138 of the Negotiable Instruments Act, 1881. This Notice is a Notice that the Unpaid Creditor shall deliver to the delinquent Debtor. According to Section 138 of the Law, the dishonor of the check is a criminal offense and is punishable by imprisonment for a period that can be extended to two years with monetary penalty or both.

Cheque Bounce Reasons

Under article 138 of the Law on negotiable instruments. There are several reasons for returning checks to consider, such as the incorrect date mentioned on the check, the mismatch of the signature, the mismatch of the amount and figures, the damaged check, the overwriting of the check, etc.

Resubmission of the dishonoured Cheque

According to Section 138 of the Law, if the drawer does not make a payment and it is discovered that the check has been dishonored, the dishonor of the check is a criminal offense and is punishable. If the beneficiary decides to proceed legally, then the possibility of paying the check amount immediately must be given to the drawer.
